Paternity leave in India has no general statutory basis in the private sector. Central Civil Services rules provide it for central government employees, but there is no equivalent central legislation obliging a private employer to grant it.

Because it is policy rather than statute, every detail is yours to set — eligibility, duration, whether it must be taken in a single block, how soon after the birth it must be used, how many times it can be claimed, and whether it applies to adoption.

What matters is writing it down. Undocumented paternity leave gets applied by manager discretion, which means it is granted generously in one team and grudgingly in another. Inconsistency in a benefit tied to the birth of a child is remembered for a very long time, and it does more damage to trust than not offering the leave at all would have done.
