Apprentices, and why they are not employees

What the distinction changes

Because an apprentice under the Act is generally not a workman, several employment protections and obligations do not attach in the ordinary way — and the stipend is not wages in the sense the wage legislation uses.

That is a meaningful benefit to an employer running a genuine training programme. It is also precisely why the arrangement attracts scrutiny.

The label does not decide it

If a person described as an apprentice is doing the same production work as the operators beside them, on the same shifts, without a structured training programme, the description is unlikely to survive examination.

What decides the relationship is the substance: a real contract of apprenticeship, in a designated trade, with actual training, records maintained, and the arrangement registered as the Act requires. Engaging cheap labour under an apprenticeship label is the specific misuse the scrutiny exists for.

Trainees are a different thing again

A company-designated "trainee" who is not engaged under the Apprentices Act is usually simply an employee on a particular grade — with all the ordinary obligations attached, whatever the designation says. Employers frequently assume the word itself creates a lighter category. It does not.

Keep the records

Registration, the contract, attendance, the stipend paid and the training actually delivered. In a dispute or an inspection these records are what distinguish a genuine programme from a labelled one, and they are exactly what tends not to exist.

Do apprentices get PF and ESI?

Apprentices engaged under the Apprentices Act are treated differently from employees for several statutory purposes, and the position depends on the category of apprentice. It is worth confirming for your specific arrangement rather than assuming either way.

Can we call someone a trainee to reduce obligations?

No. A trainee not engaged under the Apprentices Act is generally an employee with a particular designation, and the ordinary obligations apply. The designation does not create a category.

Must apprentices be offered a job afterwards?

There is no general obligation to employ an apprentice on completion, though the arrangement is intended to lead there. What matters more in practice is that the training actually happened and was recorded.

Are apprentices employees?

Their status under the applicable scheme differs from regular employment, which affects several obligations. Treating them as ordinary employees, or as outside everything, are both wrong.

Does stipend attract statutory deductions?

Treatment depends on the scheme and the engagement. It is worth confirming rather than defaulting to either extreme, because both errors accumulate quietly across an intake.

Can an apprentice be absorbed as a regular employee?

Commonly yes, and many schemes intend it. What needs care is the date regular employment begins, because entitlements that count service run from it rather than from the start of the apprenticeship.
