Minimum wages are notified by state governments for scheduled employments, and they vary along several axes at once: the industry, the skill category — unskilled, semi-skilled, skilled, highly skilled — and often the zone within the state, since a metropolitan area attracts a higher floor than a rural district.

Rates are typically revised twice a year as the variable dearness allowance component tracks the consumer price index.

The comparison itself is where employers slip. Minimum wage is tested against the prescribed components — usually basic plus DA — not against gross pay. A structure that clears the floor only by counting conveyance, house rent allowance and special allowance does not comply, however comfortable the gross figure looks.

This is also where the Code on Wages bites hardest, with its requirement that wages constitute at least half of total remuneration. A structure built on a small basic and a large special allowance fails both tests simultaneously.

The operational difficulty is currency of information. Because rates are state-notified and revised half-yearly, a multi-state employer is tracking many separate notification cycles. Employers usually discover they have fallen behind not through an inspection but through a wage-slip comparison between two workers in different states doing identical work.

Treat the minimum-wage check as a payroll flag run every cycle, not as an annual review.
